1. Scope of Application

These GTC govern the contractual relationship between Swiss Alpine Shop GmbH (hereinafter referred to as “Provider”) and participants in water sports activities and boat tours such as wakesurfing, wakeboarding, wakefoiling, water skiing, funtube rides and boat trips (hereinafter referred to as “Participants”). Deviating terms and conditions of the Participants shall not apply.

2. Participation Requirements

2.1. Participation is generally permitted from the age of 12. Minors require written consent from a parent or legal guardian unless they are present on board.
2.2. Participants in sports activities must be able to swim and be in appropriate physical and mental condition and wear the life jackets as soon as they leave the boat for the sport activity. Non-swimmers must wear life jackets during the entire stay, as an observer of a sports rider or during a boat tour.
2.3. Persons under the influence of alcohol, drugs or medication impairing fitness to participate are excluded from the activities.
2.4. The company has business liability insurance. Accident insurance is not provided. It is recommended to take out private accident and liability insurance.

3. Booking and Payment

3.1. Bookings are made online, by phone or on site and become binding upon confirmation by the Provider.
3.2. Payment must have been before the start of the activity via bank transfer, card payment or in cash on site.
3.3. In case of no-show or short-notice cancellation (less than 24 hours before the start), the full price is due unless there is a valid reason (e.g., medical certificate).

4. Implementation and Safety

4.1. The activities are conducted by qualified personnel.
4.2. Safety instructions given by the staff must be followed at all times.
4.3. Equipment (life jacket, helmet, sports gear) is provided by the Provider and must be handled with care. Damages due to improper use will be charged.
4.4. The Provider reserves the right to cancel or interrupt activities due to adverse weather conditions (storm, thunderstorm, strong waves) or technical problems. In such cases, an alternative date will be offered or the fee refunded.

5. Liability

5.1. Participation is at your own risk.
5.2. The Provider is only liable for damages caused by gross negligence or intent. Liability for simple negligence is excluded.
5.3. No liability is assumed for personal belongings.
5.4. Participants are required to inform the Provider in advance of any health restrictions.

6. Data Protection

6.1. Personal data is used exclusively for processing bookings and fulfilling legal obligations and will not be shared with third parties.
6.2. Unless participants expressly object during the activity, they agree that photo and video recordings may be used for promotional purposes (e.g., website, social media).

7. Jurisdiction and Applicable Law

7.1. Only Swiss law shall apply.
7.2. Place of jurisdiction is the registered office of Swiss Alpine Shop GmbH.

8. Severability Clause

Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid regulation that most closely reflects the economic purpose shall apply.
